Terms of Service

These Terms of Service ("Terms") govern the use of Difia HRIS, provided by PT Difia Technology Berkah ("Difia", "we"), by the company that subscribes to it ("Customer") and by the people the Customer gives access to ("Users"), including employees who use the employee app.

By registering, starting a trial, or using the Service, the Customer agrees to these Terms. A person who accepts these Terms on behalf of a company confirms that they are authorized to do so.

1. The Service

Difia HRIS is a cloud-based human resources and payroll service consisting of the web application, the employee app for Android and iOS, and related features such as attendance, schedules, leave, overtime, claims, payroll, and reports. The features available depend on the Customer's plan.

2. Accounts and access

  • The Customer is responsible for the users it invites, the roles and access it gives them, and for deactivating users who should no longer have access.
  • Users must keep their passwords and PINs confidential and must not share their accounts.
  • The Customer must tell us promptly about any unauthorized use of an account or other security issue.

3. Free trial

A free trial may be offered for the period shown on our website, with the features stated there. No payment is required during the trial. At the end of the trial, the Customer can choose a paid plan; otherwise access ends and the data is handled as described in the Privacy Policy.

4. Plans, fees, and payment

  • Fees follow the plan chosen by the Customer and the prices published on our website or agreed in writing. Prices are per company and exclude value added tax (PPN).
  • Plans billed per active employee are charged based on the number of active employees, subject to any minimum stated in the plan.
  • Invoices are issued monthly or yearly in advance and paid through the payment methods we provide. If an invoice remains unpaid after its due date and a reminder, we may suspend access until it is paid.
  • Fees that have been paid are non-refundable, except where required by law or agreed in writing.
  • We may change prices for future billing periods by giving at least 30 days' notice.

5. Customer data

  • The Customer owns the data it enters into the Service. We process it only to provide the Service, as described in the Privacy Policy, and act as the Customer's data processor.
  • The Customer is responsible for having a lawful basis to process its employees' personal data, for informing its employees, and for the accuracy of the data and settings it enters.
  • The Customer can export its data while its subscription is active and for a limited period afterwards, as described in the Privacy Policy.

6. Payroll, tax, and BPJS calculations

The Service calculates pay, BPJS contributions, and income tax using rates and rules that Difia maintains based on the applicable regulations, together with the settings chosen by the Customer. The Customer remains responsible for reviewing and approving each payroll, for paying salaries, contributions, and taxes, and for filing its reports with the authorities. Difia does not provide tax or legal advice.

7. Acceptable use

Customers and Users must not:

  • use the Service for any unlawful purpose or to process data without a lawful basis;
  • attempt to bypass security or attendance controls, including the use of fake GPS or mock-location apps;
  • access data or accounts they are not authorized to access;
  • copy, modify, reverse engineer, or resell the Service, except as allowed by law;
  • upload malicious code or place an unreasonable load on the Service.

8. Availability and support

We work to keep the Service available at all times, but it may occasionally be unavailable because of maintenance, updates, or events outside our control. We will try to announce planned maintenance in advance. Support is provided by email and WhatsApp, with priority support for plans that include it.

9. Intellectual property

Difia owns the Service, including its software, design, and content. During the subscription, the Customer and its Users receive a limited, non-exclusive, non-transferable right to use the Service for the Customer's internal business purposes.

10. Confidentiality

Each party will keep the other party's confidential information confidential and use it only for the purposes of these Terms, except where disclosure is required by law.

11. Limitation of liability

To the extent permitted by law, Difia is not liable for indirect or consequential losses, such as loss of profit or business. Difia's total liability for any claim relating to the Service is limited to the fees the Customer paid in the 12 months before the event that gave rise to the claim.

12. Suspension and termination

  • The Customer may stop its subscription at any time; the stop takes effect at the end of the paid billing period.
  • We may suspend or end access if the Customer does not pay, seriously breaches these Terms, or uses the Service in a way that endangers the Service or other Customers. Where possible, we will give notice first.
  • After termination, the Customer's data is handled as described in the Privacy Policy.

13. Changes to these Terms

We may update these Terms. We will notify Customers of material changes before they take effect. Continuing to use the Service after a change takes effect means accepting the updated Terms.

14. Governing law and language

These Terms are governed by the laws of the Republic of Indonesia. The parties will first try to resolve any dispute amicably; if that fails, the dispute will be settled by a competent court in Indonesia.

These Terms are available in Bahasa Indonesia and English. If the two versions differ, the Bahasa Indonesia version prevails.
